Welcome to DoctorFresco.com. These Terms and Conditions (“Terms”) govern your access to and use of DoctorFresco.com and your purchase or use of products and services offered by Doctor Fresco LLC, a North Carolina limited liability company (“Doctor Fresco,” “we,” “us,” or “our”).
Our products and services may include online courses, educational programs, certification programs, live seminars, webinars, coaching or Q&A; sessions, consulting services, speaking engagements, books, digital materials, assessments, marketing analyses, neuromarketing services, artificial-intelligence-assisted services, and other related products and services.
By accessing our website, purchasing a product or service, enrolling in a program, or affirmatively accepting these Terms during checkout, you agree to be bound by these Terms. If you do not agree with these Terms, do not purchase or use our products or services.
1. Educational and Professional Purpose
Doctor Fresco provides educational, training, consulting, marketing, neuromarketing, behavioral science, and related professional services. Our educational programs are intended to provide information, frameworks, strategies, and training. They do not constitute medical, psychological, legal, financial, investment, or tax advice. Nothing contained in our courses, website, presentations, publications, analyses, or other materials creates a doctor-patient, therapist-patient, attorney-client, financial-adviser, or similar professional relationship.
2. No Guarantee of Business or Financial Results
Doctor Fresco may provide strategies, scientific research, behavioral principles, marketing recommendations, analyses, examples, case studies, and other information intended to help participants improve their understanding and decision-making. However, we do not guarantee any specific financial, marketing, sales, conversion, business, career, or other result. Results vary based on numerous factors outside our control, including implementation, market conditions, product quality, pricing, competition, audience, advertising, customer behavior, and business execution. Testimonials, case studies, examples, simulations, analyses, and previous results are illustrative and should not be interpreted as promises or guarantees of future performance.
3. Buyer Brain Blueprint
Buyer Brain Blueprint is a Doctor Fresco educational program focused on neuromarketing, behavioral science, consumer psychology, persuasion, marketing, and related subjects. Enrollment may include prerecorded educational materials as well as live seminars, Q&A; sessions, calls, workshops, supplemental materials, or other benefit described at the time of purchase. Program components, schedules, instructors, delivery methods, and supporting materials may be reasonably modified or updated as the program evolves, provided that the fundamental nature of the purchased program is not materially diminished.
4. Buyer Brain Blueprint 30-Day Money-Back Guarantee
Buyer Brain Blueprint purchases are covered by a 30-day money-back guarantee. If you are not satisfied with Buyer Brain Blueprint for any reason, you may request a refund within 30 calendar days of your original purchase date. The guarantee remains available even if you have accessed course materials or participated in included live seminars, Q&A; sessions, workshops, or calls during the 30-day period.
To request a refund, email refund@doctorfresco.com from the email address associated with your purchase and include the purchaser’s full name. Eligible refunds will be returned to the original payment method. Once a refund is issued, access to Buyer Brain Blueprint and associated program materials and benefits will terminate.
Refund requests received after the 30-day guarantee period are not eligible for a refund except where otherwise required by applicable law.
This guarantee applies specifically to Buyer Brain Blueprint and does not automatically apply to separately purchased consulting services, speaking engagements, custom analyses, other courses, certification programs, or other Doctor Fresco products or services unless specifically stated at the time of purchase.
5. Prices, Payments, and Promotional Offers
Prices are displayed before purchase and may change at any time for future purchases. Doctor Fresco may periodically offer discounts, promotional codes, launch pricing, event pricing, scholarships, bundles, or other special offers. Promotional pricing does not create an entitlement to the same price for previous or future purchases.
Promotion codes may be subject to eligibility requirements, expiration dates, redemption limits, product restrictions, or other conditions. Unless otherwise stated, promotional codes cannot be combined. Payments may be processed through third-party payment processors, including Stripe. Your use of those payment services may also be subject to the provider’s applicable terms and policies.
6. Course and Digital Product Access
Purchasing a course or digital product gives you a limited, personal, non-exclusive, non-transferable license to access and use the materials for your own lawful educational or professional purposes. Purchasing access does not transfer ownership of the course, curriculum, videos, presentations, frameworks, graphics, assessments, software, written materials, methodologies, or other intellectual property. Unless we expressly authorize it in writing, you may not share login credentials; give another person access to your account; copy or redistribute course materials; record or redistribute course videos or live sessions; upload course materials to file-sharing services; resell or sublicense course materials; publish substantial portions of the program; use course materials to create a substantially derivative competing course or product; or remove copyright, trademark, or proprietary notices. Reasonable personal notes and internal application of concepts learned through the program are permitted.
7. Intellectual Property
DoctorFresco.com and the materials made available through Doctor Fresco products and services may contain intellectual property owned by Doctor Fresco LLC or licensed to it. This may include text, videos, graphics, presentations, course materials, methodologies, frameworks, branding, logos, designs, assessments, software, analyses, and other original materials. Except for the limited rights expressly granted under these Terms, no intellectual-property rights are transferred to the purchaser. Third-party research, publications, trademarks, images, examples, and other materials remain the property of their respective owners.
8. Live Sessions and Events
Certain programs may include live seminars, webinars, Q&A; sessions, workshops, group calls, or other live components. Dates, times, speakers, formats, and schedules may occasionally change. Where reasonably practicable, Doctor Fresco will provide notice of material scheduling changes. Participation in live sessions must be respectful and lawful. Doctor Fresco reserves the right to remove participants whose conduct is abusive, threatening, disruptive, fraudulent, unlawful, or materially interferes with the experience of other participants.
9. Recordings of Live Sessions
Doctor Fresco may record certain live educational sessions for educational, archival, or program-delivery purposes. Where participants may be identifiable in a recording, appropriate notice or consent will be provided when required. Participants should not disclose confidential, proprietary, medical, financial, or other sensitive information during group sessions.
10. Certification Programs
Enrollment in a Doctor Fresco course does not automatically guarantee certification unless the particular program expressly provides otherwise. Certification programs may have requirements such as completion of specified materials, assessments, assignments, attendance, examinations, or other criteria communicated to participants.
Doctor Fresco may withhold or revoke certification in cases of fraud, academic dishonesty, material violation of program requirements, unauthorized sharing of course materials, or misrepresentation of credentials. A Doctor Fresco certification is a private professional educational credential. It should not be represented as a government license, university degree, medical credential, or other regulated professional license unless expressly stated otherwise.
11. Consulting Services
Consulting, custom marketing analysis, neuromarketing analysis, business advisory work, or other individualized services may be governed by a separate proposal, statement of work, engagement agreement, or contract. Where a separate written agreement exists, that agreement will control to the extent it conflicts with these general Terms. The Buyer Brain Blueprint 30-day money-back guarantee does not automatically apply to separately contracted consulting or custom services.
12. AI-Assisted Analysis and Technology
Some Doctor Fresco services may use artificial intelligence, predictive models, analytics, eye-tracking simulation or analysis, behavioral frameworks, software tools, or other technology. These tools are intended to assist analysis and decision-making and should not be interpreted as guarantees of human behavior, customer response, sales performance, or business outcomes. AI-generated or model-assisted outputs may contain errors or limitations and should be evaluated using appropriate professional judgment.
13. Scientific Information and Research
Doctor Fresco may discuss scientific studies, psychological research, neuroscience, behavioral economics, marketing research, and other academic or professional literature. Scientific knowledge evolves. Research findings may later be replicated, refined, challenged, or superseded by subsequent evidence. Our educational materials should therefore be understood as educational interpretations of available information rather than permanent scientific certainty.
14. User Conduct
You agree not to use Doctor Fresco products, services, websites, or communities to violate applicable law; infringe intellectual-property rights; distribute malware or malicious software; harass or threaten others; attempt unauthorized access to systems or accounts; circumvent access restrictions; share purchased credentials or protected materials without authorization; misrepresent your identity or credentials; or engage in fraudulent payment activity. Material violations may result in suspension or termination of access.
15. Third-Party Platforms and Services
Doctor Fresco may use third-party services for payment processing, video hosting, email, course delivery, analytics, communications, artificial intelligence, website hosting, scheduling, or other business functions. We are not responsible for temporary interruptions or failures caused solely by third-party platforms outside our reasonable control. Use of third-party services may also be subject to those providers’ respective terms and privacy policies.
16. Privacy
Our collection and use of personal information is governed by our Privacy Policy. A separate Privacy Policy should be available at DoctorFresco.com/privacy. Where applicable, Stripe and other third-party providers may independently process information according to their own privacy policies.
17. Chargebacks and Payment Disputes
If you believe a charge was made incorrectly, please contact Doctor Fresco before initiating a payment dispute so that we have an opportunity to investigate and resolve the issue. Nothing in these Terms prevents you from exercising lawful rights available through your payment provider or applicable consumer-protection law. Fraudulent chargebacks or intentional misrepresentations regarding authorized transactions may result in termination of program access and may be contested using relevant transaction and access records.
18. Availability and Modifications
We may update, improve, replace, or modify portions of our website, courses, services, and materials from time to time. We may also discontinue products or services prospectively. Where a customer has already purchased a product, we will use reasonable efforts to provide the purchased product or a reasonably equivalent means of access, subject to these Terms.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOCTOR FRESCO LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF OUR PRODUCTS, SERVICES, OR WEBSITE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCTOR FRESCO LLC’S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE OR SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO DOCTOR FRESCO LLC FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Doctor Fresco LLC from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of our products or services, your material violation of these Terms, or your infringement of another person’s rights.
21. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute will be subject to applicable federal and North Carolina law and any mandatory consumer-protection or jurisdictional rights that cannot lawfully be waived.
22. Electronic Acceptance
By affirmatively accepting these Terms electronically, including by checking an acceptance box during checkout, you indicate your agreement to these Terms. You should retain a copy of these Terms for your records.
23. Changes to These Terms
We may update these Terms periodically. Changes will apply prospectively unless applicable law permits otherwise. The version in effect when you make a purchase generally governs that transaction, subject to any separate written agreement. The effective date and last-updated date appear at the top of this document.
24. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
25. Entire Agreement
These Terms, together with applicable product-specific terms, our Privacy Policy, and any separate written agreement applicable to a particular service, constitute the agreement between you and Doctor Fresco LLC regarding the applicable product or service. Where a separately signed agreement conflicts with these Terms, the separately signed agreement controls with respect to the subject matter it covers.
